Slesinger Seeks to Revive "Pooh" Suit

Stephen Slesinger Inc., which had a lawsuit against the Walt Disney Co. dismissed last year, has filed an appeal to have the suit reinstated, the company said today. Slesinger claims that Disney owes it more that $700 million in royalty payments off of the Winnie the Pooh characters.

The original suit was dismissed after an investigator working for Slesinger admitted to rummaging through a dumpster to retrieve discarded Disney documents. The court dismissed the suit as a sanction against the investigator’s conduct.

In its appeal, Slesinger will argue that the California trial judge exceeded his authority by dismissing the suit. The appeal will also argue that a Slesinger-proposed remedy could have met the court’s concerns, making a dismissal unnecessary, and that the dismissal had the effect of giving Disney a “windfall.”
