In the may issue of Gameinformer they have a preview for X-Men Legends 2 and mention how the movies grossed over 700 mill in the worldwide box office but the most supprising thing they said.

Didn't X-men: Evolution already have four seasons (4 thirteen episode seasons)?

There was 4 seasons. Seasons 1 and 3 were both 13 episodes, two had 17 and the final season had 9.

And with the crew now working on The Ultimate Avengers, I'd say it's more a screw up than anything. Still, dissapointing.
